These Terms & Conditions apply to your use of the Three B Creations website and to purchases, custom requests and personalised creations supplied by us. By placing an order, approving a quote or using this website, you agree to these terms.

2. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable Australian law.
If there is any inconsistency between these terms and a non-excludable consumer right, the consumer right prevails.
3. Products and Custom Creations
We sell ready-made, personalised and custom-made products. Product photographs, colours and screen previews are intended to be a reasonable representation only. Handmade, printed, engraved and 3D-printed items may have minor variations that are inherent to the production process and are not defects.
For personalised or custom products, you are responsible for checking the names, dates, wording, colours, quantities, sizes, uploaded images and other instructions you provide. We may contact you if clarification is required before production begins.
4. Orders and Acceptance
Submitting an order does not necessarily mean we have accepted it. We may decline or cancel an order before production where, for example, an item is unavailable, information is incomplete, a pricing error is identified, payment is not completed, or the requested content is unlawful or cannot reasonably be produced.
An order is accepted when we confirm it, begin production, or otherwise communicate acceptance. If we cannot accept a paid order, we will arrange an appropriate refund.
5. Custom Requests and Quotes
A Request a Quote submission is an enquiry and does not create a binding order. We may discuss specifications, pricing, timing, delivery or pickup before issuing or confirming a quote.
A custom quote is based on the information available when it is prepared. Changes requested after a quote is accepted may affect price, production time and delivery. Production may not begin until required information and payment have been received.
6. Pricing, GST and Payment
All prices are displayed in Australian dollars.
Three B Creations is not currently registered for GST, and GST is not added to the displayed prices. Delivery charges and any optional extras will be clearly displayed before payment.
Online payments are processed through Stripe Checkout. We do not intentionally store complete payment-card details on our website. Your payment may also be subject to Stripe's terms and privacy practices.
7. Personalisation, Proofs and Customer-Supplied Content
Where we provide a proof or request confirmation, you must carefully review it before approval. Once a proof or personalised specification is approved and production has begun, changes may not be possible and may incur additional cost.
If you upload photographs, artwork, logos, wording or other material, you confirm that you have the right or permission to provide and use that material for the requested product.
You grant us permission to use the supplied material only as reasonably necessary to prepare, produce and fulfil your order, communicate with you about it, and meet our legal obligations.
We may refuse content that we reasonably consider unlawful, infringing, abusive, discriminatory, defamatory, unsafe or otherwise inappropriate.
8. Production and Timeframes
Any production, dispatch or completion date we provide is an estimate unless we expressly agree otherwise in writing.
Custom work can be affected by design changes, material availability, equipment issues, delivery networks and other circumstances outside our reasonable control. We will take reasonable steps to keep you informed about material delays.
If you require an item by a particular event or date, tell us before placing or approving the order. We do not guarantee a deadline unless we expressly confirm it.
9. Delivery and Local Pickup
Available delivery and local-pickup options are displayed during checkout or agreed as part of a custom quote. You are responsible for providing accurate delivery and contact details.
Risk of loss or damage will be dealt with in accordance with applicable law. If tracking shows an issue, or an item arrives damaged, contact us as soon as reasonably possible so we can investigate with the carrier and assess the available remedy.
For local pickup, we will provide pickup information when the order is ready. Please do not attend for collection until you have received confirmation that your order is ready.
10. Cancellations and Change of Mind
Because personalised and custom-made products are made or prepared specifically to your requirements, we may be unable to cancel, change or refund an order for change of mind once production has commenced or materials have been committed specifically to your order.
For non-personalised products, Three B Creations does not ordinarily accept returns or provide refunds solely because a customer changes their mind. Three B Creations may agree to a change-of-mind return, exchange or refund at its discretion.
This change-of-mind policy does not exclude, restrict or modify any rights or remedies available to customers under the Australian Consumer Law.
If an item is faulty, damaged, not as described or otherwise fails to meet a consumer guarantee under the Australian Consumer Law, you may be entitled to a repair, replacement, refund or other applicable remedy.
11. Faulty, Damaged or Incorrectly Supplied Products & Product Safety Information
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances and whether a failure is major or minor, you may be entitled to a repair, replacement, refund or another remedy required by law.
Please contact us with your order details and, where helpful, photographs showing the issue. We may ask you to return an item where reasonably necessary to assess or provide the remedy. We will not require you to give up rights that apply under the Australian Consumer Law.
Some Three B Creations products may contain small parts, detachable components or decorative elements that may present a choking hazard. Unless a product is specifically described as a toy, our products are intended for decorative, display or their stated purpose and should not be treated as toys.
Products containing small parts are not suitable for children under 3 years of age. Children should be supervised by a responsible adult when handling products that contain small, detachable or potentially hazardous components.
Customers should follow any product-specific safety, care and usage instructions supplied with the product. Products should only be used for their intended purpose.
Where a product has specific safety requirements, warnings, age recommendations or usage restrictions, customers should also review the safety information provided in the individual product description before purchasing or using the product.
12. Intellectual Property
Unless otherwise stated, the business branding, original product photographs, text and original designs displayed by Three B Creations are owned by us or used with permission and are protected by applicable intellectual-property laws.
Purchasing a product does not transfer intellectual-property rights in our designs or branding.
Customer-supplied photographs, artwork, logos and other materials remain the property of their respective owners, subject to the limited permission provided under these terms for us to use those materials as reasonably necessary to fulfil the customer's request.
13. Website Use
You must not misuse the website, interfere with its security or operation, attempt unauthorised access, introduce malicious code, scrape the site in a way that materially disrupts it, or use the site for unlawful purposes.
We may update, suspend or change parts of the website from time to time. We take reasonable care with website information but cannot guarantee that every item, image, description or availability status is error-free at all times.
14. Third-Party Services and Links
Our website may use or link to third-party services, including payment, delivery, hosting, email and social-media providers.
Those services may have their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control, subject always to any responsibility we have under applicable law.
15. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach of a non-excludable obligation.
Nothing in this section excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
16. Privacy
We handle personal information and customer-supplied photographs, artwork and files as described in our Privacy Policy and in accordance with applicable Australian privacy requirements.
Our Privacy Policy provides further information about the collection, use, storage, retention and deletion of customer information and uploaded files.
17. Changes to These Terms
We may update these terms from time to time.
The version published on the website at the time an order is placed will ordinarily apply to that order, unless a change is required by law or we agree otherwise with you.
The website will display the date on which these Terms & Conditions were last updated.
18. Governing Law
These terms are governed by the laws applicable in South Australia and the Commonwealth of Australia.
The parties submit to the courts and tribunals having jurisdiction in South Australia, subject to any rights you may have to bring a claim elsewhere under applicable consumer law.
